These terms of use (Terms) constitute a legally binding agreement between User or you (as defined below) and Nife Healthcare Private Limited(the “Company” / “NHC”) regarding your use of the NifeCard web site (the Site), the NifeCard App, and other associated services.

“User” or “You” means any person who accesses, avails, or uses this website or the app of the Company for the purpose of hosting, publishing, sharing, transacting, displaying or uploading information or views and includes other persons jointly participating in using the site or the app of the Company. By accessing the Site, App or Service , you agree to be bound by these Terms. You hereby represent and warrant to the Company that you are at least eighteen (18) years of age or above and are capable of entering, performing and adhering to these Terms and that you agree to be bound by the following terms and conditions. While individuals under the age of 18 may utilise the Service of the site, they shall do so only with the involvement and guidance of their parents and / or legal guardians.

The Company reserves the right, at its discretion, to change, modify, add, or remove portions of these Terms at any time by posting the amended Terms. Please check these Terms periodically for changes. Your continued use of the App and Website after the posting of changes constitutes your binding acceptance of such changes. In addition, when using any particular services, you may be subject to any posted guidelines or rules applicable to such services. All such guidelines or rules are hereby incorporated by reference into the Terms. If you do not agree with the Terms, please do not use this Site or associated Apps.

Electronic Communication

When you visit https://www.NifeCard.com/ or send emails to us, you are communicating with us electronically, and you consent to receive communication from us electronically. We will communicate with you by e-mail or by posting notices on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing.

License and Website Access

General: NHC Pvt Ltd grants you a limited license to access and make personal use of this website and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of NHC Pvt Ltd.

No license for commercial sale: This license does not include any resale or commercial use of this website or its content; any collection and use of any product listing, description, or pricing; copying of account information for the benefit of another merchant; or any use of data mining, or similar data gathering and extraction tools.

No reproduction: This website or any portion of this website may not be reproduced, duplicated, copied or otherwise exploited for any commercial purpose without express written consent of NHC Pvt Ltd.

No framing: You may not frame or utilize framing technologies to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of http://www.nifecard.com/ without the express written consent of NHC.

Repayments, Refunds and Cancellation

Repayments:

Credit Card bill & Prepaid Card - Topup & repayments can be done via app through Razorpay Payment Gateway using Debit Card, Netbanking, or UPI, on the Make Payment page. In case of any issues, you can reach out to us from the app itself or email us on Hello@NifeCard.com

Refunds and Cancellation: In case a transaction is cancelled or if any refund is due, it will be credited to the same debit card or bank account from where the transaction was initiated.

Reviews, Comments, Communications, and other content

Nature of content:Visitors to http://www.NifeCard.com/ may post content and other communications; and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights to otherwise injuries to third party or objectionable and does not consist of or contains software virus, political campaigning, commercial solicitation, mass mailing or any form of spam.

False information:You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. NHC Pvt Ltd reserves the right (but not the obligation) to remove or edit such content posted on http://www.NifeCard.com/

Rights Granted: If you do post content or submit material and unless we indicate otherwise, you grant NHC Pvt Ltd a non-exclusive, royalty free, perpetual, irrevocable, and fully sub-licensed right to use, reproduce, modify, adapt, publish, translate, create derivative work from, distribute, and display such content throughout the world in any media. You grant NHC Pvt Ltd the right to use the name that you submit in connection with such content on http://www.NifeCard.com/

Right Owned: You represent and warrant that you own all the rights or otherwise or control all of the rights to the content that you post; that the content is accurate; that the use of the content to supply does not violate this policy and will not cause injury to any person or entity and that you will indemnify NHC Pvt Ltd for all claims resulting from the content you provide/post on http://www.NifeCard.com/. NHC Pvt Ltd takes no responsibility and assumes no liability for any content posted by you or any third party.

Site Policies, Modification, and Severability We reserve the right to make changes to our website, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and will not affect the validity and enforceability of any remaining conditions.

Recruitment

Fraud Recruitment Offers

It has come to our notice that fake job offers are being circulated in the name of NHC Pvt Ltd Private Limited (“NHC”) by certain individuals. These individuals are also unauthorisedly using the name and trademark of NHC and NifeCard.

NHC does not:

  1. send job offers from free email services like Gmail, Rediffmail, Yahoo mail, Hotmail, etc;
  2. request payment of any kind from prospective candidates for employment or any sort of fees; and
  3. request for an interview or will make any job offers on or through any instant messaging applications

NHC currently has only one office situated at Ground Floor, 36, Infantry Rd, Tasker Town, Shivaji Nagar, Bengaluru, Karnataka 560001 (“NHC’s Office”) and does not make any job offer for any other locations in India.

NHC’s Hiring Process

  1. NHC team only corresponds from email id careers@nifecard.com for any job opportunity at NHC or any other email id from the NifeCard.com domain
  2. All offers of NHC will only be made from an email id on the NifeCard.com domain, or will be made in person at NHC’s Office
  3. The hiring process involves at least one in-person interview at NHC’s Office premises

NHC will not be responsible to anyone acting on employment offers not made by NHC as per the hiring process set out above. NHC will not have any obligation to honour terms of any fake offer letter so issued, or provide employment to anyone who has been issued a fraudulent offer letter. Further, NHC is not responsible for any losses (monetary or otherwise) including but not limited to loss of data that are incurred as a consequence of fake job offers.

If you believe you have been a victim of a recruitment fraud, you are requested to approach the law enforcement agencies immediately.

Intellectual Property Rights

Copyright Protection: All content included on the site, such as text, graphics, logos, button icons, audio and video clips, digital downloads, data compilations and software, is the property of NHC Pvt Ltd and protected by Indian Copyright law.

Governing Law and Jurisdiction These terms and conditions will be construed only in accordance with the laws of India. In respect of all matters/disputes arising out of, in connection with or in relation to these terms and conditions or any other conditions on this website, only the competent Courts at Bangalore, Karnataka, India shall have jurisdiction, to the exclusion of all other courts.

Disclaimer of warranties and Limitation of Liability You agree that NHC Private Limited provides the website on an “as is”, “with all faults” and “as available” basis. No representations, warranties or guarantees whatsoever are made by NHC Pvt Ltd as to the (a) accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation; (b) that the service will be uninterrupted, timely, secure, or error-free; ( c) the quality of any services, content, information, or other material on the website or Apps will meet your expectations or requirements; (d) any errors in the Site and the App will be corrected; (e) warranties against infringement of any third party intellectual property or proprietary rights; or (f) other warranties relating to performance, non-performance, or other acts or omissions of the Company, its officers, directors, employees, affiliates, agents, licensors, or suppliers.

The Company does not warrant that any of the software used and or licensed in connection with this website or its Apps will be compatible with other browsers, third party software or devices nor does it warrant that operation of the website and Apps and the associated software will not damage or disrupt other software or hardware.

The Company, its affiliates, successors, and assigns, and each of their respective investors, directors, officers, employees, agents, and suppliers (including distributors and content licensors) shall not be liable, at any time for any, direct, indirect, punitive, incidental, special, consequential, damages arising out of or in any way connected with the use of the website or Apps, whether based in contract, tort, strict liability, or other theory, even if the Company have been advised of the possibility of damages.
